The Role Of A Judge

The Role Of A Judge

Defend Yourself?

Do you know your rights? If not, you have none.

  1. The role of a judge in a Crown Court. In England and Wales, Crown Courts are where serious criminal cases are heard by a judge and jury.  In those cases, the judge makes decisions about the law and manages the trial. The jury considers the evidence, and decides whether the person on trial is guilty or innocent.

Civil Law
The main intention of the civil law is to protect individuals against one another specifying the rights and duties of individuals.   Civil law is the branch of law dealing with disputes between individuals or organizations, in which compensation may be awarded to the victim.

The Law Relating to Civil Wrongs and Quasi-Contract is part of the civil law

A civil wrong or wrong is a cause of action under the law of England and Wales. Tort,  breach of contract and breach of trust[4] are types of civil wrong.  A quasi-contract (or implied-in-law contract) is a fictional contract created by courts for equitable, not contractual purposes. A quasi-contract is not an actual contract, but is a legal substitute for a contract formed to impose equity between two parties. The concept of a quasi-contract is that of a contract that should have been formed, even though in actuality it was not. It is used when a court finds it appropriate to create an obligation upon a non-contracting party to avoid injustice and to ensure fairness.

Judicial Accountability

Stare decisis is a legal principle by which judges are obliged to respect the precedents established by prior decisions.

“Public law is not at base about rights, even though abuses of power may and often do invade private rights; it is about wrongs – that is to say, misuses of public power.”

Care Proceedings are initiated under the doctrine of Civil Law.
